Terms of Use

These Terms of Use ("Terms") are a contract between you and Pink Lumenade LLC, 3130 Balfour Rd, Suite D #1023, Brentwood, CA 94513, USA ("we", "our"). They cover the Upscore apps for iOS and Android, the Upscore watch apps for Apple Watch and Wear OS, the Upscore desktop companion, the app at edi.dance, and the website at upscore.dance (together, "Upscore"). By creating an account or using Upscore, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Upscore.
1. Who Can Use Upscore
You must be at least 13 years old to use Upscore. If you are under 13, do not create an account. If we learn an account belongs to someone under 13, we will close it and delete its data. By using Upscore you confirm that the information you provide is accurate and that you are responsible for any activity under your account. Keep your login credentials secure.
2. License to Use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use Upscore for your own non-commercial use, subject to these Terms and to the terms of the app store you obtained Upscore from. If you got Upscore from the Apple App Store, Apple's Licensed Application End User License Agreement applies to your use of the app. These Terms add to it. If they conflict, Apple's agreement controls for the app on iOS and these Terms control for everything else. If you got Upscore from Google Play, the Google Play Terms of Service apply.
3. Subscriptions, Billing & Cancellation
Upscore is free to use for score tracking. Recording sessions is free for your first three sessions; after that, sessions need Upscore Pro or Upscore League. Deleting a session does not give a free session back. We may change what the free tier includes and will tell you in the app before it changes.
Pro and League are optional paid subscriptions, available monthly or annually. The following applies to all auto-renewable subscriptions purchased through the Apple App Store or Google Play:
- Payment is charged to your App Store (Apple ID) or Google Play account at confirmation of purchase, depending on where you buy.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period, at the price for the selected plan.
- Where we offer a free trial, it lasts 7 days. You are charged the plan price when the trial ends unless you cancel at least 24 hours before it ends. The price and the trial end date are shown before you confirm. Any unused portion of a trial is forfeited when you purchase a subscription.
- You can manage or cancel your subscription at any time in your App Store or Google Play account settings after purchase.
- Prices are shown in the app before purchase. If a price goes up, you will be told before it applies to you and can cancel before then.
Purchases are processed by Apple (App Store) or Google (Google Play). Refunds are handled by the respective app store in accordance with its terms; we do not separately process payments or refunds.
4. Score Data & Third-Party Services
Upscore lets you import and analyze your own gameplay data through services such as Sanbai, PhaseII, LIFE4, e-amusement and Pump It Up. You decide whether to connect a service, and you can disconnect at any time. Your use of those services is governed by their own terms and policies, and their availability is outside our control. You are responsible for ensuring you are permitted to access and import your own data from those services. The desktop companion reads the result screen on your own PC.
5. Independence & Trademarks
Upscore is an independent application. It is not affiliated with, endorsed by, sponsored by, or associated with Konami Digital Entertainment, Andamiro, or any game publisher. Dance Dance Revolution, DDR, e-amusement, BEMANI and KONAMI are trademarks of Konami Digital Entertainment. Pump It Up is a trademark of Andamiro. Sanbai, PhaseII and LIFE4 are independent community projects. We use these names only to tell you which game or service a feature works with.
Song art and titles. Upscore shows song titles and jacket art so you can recognise your charts, including on the session cards it makes for you. That art belongs to the game publishers. We do not claim any rights in it. If you own rights in something Upscore shows and want it removed, email rinon@edi.dance with a link to the item, proof you own it, and your contact details, and we will take it down promptly.
6. Health & Fitness Disclaimer
Upscore is a fitness and gameplay tool, not a medical device or a provider of medical advice. Heart rate, calorie, workout, and other figures are estimates for informational purposes only and should not be relied on for any medical decision. Trends, comparisons and recovery signals are built from those estimates and can be wrong. They are not a diagnosis, and a change in them is not a medical finding. Physical activity carries risk. Consult a qualified healthcare professional before beginning or changing any exercise program, and stop if you feel unwell. You use Upscore and engage in physical activity at your own risk.
7. Acceptable Use
You agree not to misuse Upscore, including by attempting to access other users' data, reverse-engineering the app except as permitted by law, interfering with its operation, using bots or scripts against our servers, uploading unlawful or harmful content, or using it to violate any third party's rights or any applicable law.
8. Things You Upload or Share
Upscore lets you upload a profile photo, score files and play logs, photos of a results screen, and submissions to LIFE4, and lets you share session cards Upscore makes for you. You are responsible for what you upload. By uploading it you confirm that you own it or have the right to use it, and that it does not infringe anyone else's rights.
Content standards. Do not upload anything that is unlawful, sexually explicit, hateful, harassing, violent, deceptive, or that depicts or exploits a minor. Do not upload an image of another person without their permission, or one that impersonates someone else.
Permission you give us. You keep ownership of what you upload. You give us a limited, non-exclusive, worldwide, royalty-free licence to store, process, reproduce and display it for the sole purpose of operating Upscore and showing it back to you. This licence ends when you delete the item or your account, apart from copies that may briefly remain in backups or caches.
Session cards. A session card can include song art that belongs to a game publisher. When you share a card outside Upscore, you do so on your own account.
Removal. You can remove your uploads at any time in the app. We may also remove content, or disable a user's ability to upload, if we believe in good faith that it breaches these Terms or applicable law, including without prior notice where the content is unlawful or harmful.
Reporting. If you believe content in Upscore is unlawful or breaches these Terms, contact us at rinon@edi.dance. We review reports and act on them promptly, and we have no tolerance for objectionable content.
9. Intellectual Property
Upscore, including its software, design, text, and original graphics, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights in Upscore except the limited license described above.
10. Disclaimers
Upscore is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Upscore will be uninterrupted, error-free, or that data synced from third-party services will be accurate or complete.
11. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of Upscore. Our total liability for any claim relating to Upscore will not exceed the amount you paid us for the service in the 12 months before the claim, or USD $50 if you paid nothing. Nothing in these Terms limits our liability for death, personal injury, fraud or gross negligence where the law does not allow that.
12. Termination
You may stop using Upscore and delete your account at any time from within the app. We may suspend or terminate access if you violate these Terms or if required by law. Sections that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will continue to apply.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the app or via email. The "Last updated" date above reflects the most recent revision. Continued use of Upscore after changes take effect means you accept the updated Terms.
14. Law and Courts
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts in Contra Costa County, California, and you agree to that. If you are a consumer and the law where you live gives you protections or a home court that this clause cannot take away, you keep them.
15. Whole Agreement
These Terms and the Privacy Policy are the whole agreement between you and us about Upscore. If a court finds part of them unenforceable, the rest still applies.
16. Assignment
You cannot transfer your account or these Terms to anyone else. We may transfer them to a company that takes over Upscore, and we will tell you if we do.
17. No Waiver
If we do not enforce a term right away, we can still enforce it later.
18. Export Rules
You confirm you are not in a country under US embargo and not on a US government restricted list.
